What Is This Rule?

In January 2024, the Department of Labor (DOL) under the Biden administration finalized a rule that changed the criteria for determining who is an "employee" vs. "independent contractor" under the Fair Labor Standards Act (FLSA).

The Biden rule applied a six-factor "economic reality" test that made it harder to classify workers as independent contractors.

Translation: more workers would be reclassified as "employees", forcing companies to pay benefits, social security, workers' compensation, etc.

Who Does It Affect?

According to DOL estimates, the rule would affect approximately 350,000 workers in the United States, including:

  • Owner-operators in trucking
  • Ride-share drivers (Uber, Lyft)
  • Construction workers
  • Freelancers and consultants

For owner-operators, this is a huge problem. Many operate under lease agreements with carriers. Under the Biden rule, these contracts could be considered "employment relationships" instead of independent agreements.

What Is the Trump Administration Doing?

The Department of Labor under Trump published a Proposed Rescission Rule on March 11, 2026, seeking to eliminate the Biden rule and return to previous standards.

The proposal is now in a 30-day public comment period. After that, the DOL can finalize it and officially rescind the Biden rule.

If the Biden rule remained in effect, many owner-operators could be reclassified as employees. This would have massive consequences:
