Proposed EPA change keeps NoX limits in place, impacts other truck regulations

The EPA is proposing changes to several heavy-duty truck provisions without lowering the nitrogen oxide limits established for model-year 2027 engines. The most visible change for operators involves what happens when a truck detects an emissions-system problem or low DEF: instead of reducing power or stopping the truck, the proposal calls for visual and audible warnings.

The NOx limits remain in place

The proposal keeps the stricter NOx standards and test cycles adopted in the 2023 final rule. It does not remove the central emissions target for heavy-duty engines.

The EPA estimates that the amended version would preserve about 90% of the NOx reductions projected under the original rule. It also projects on-road heavy-duty NOx emissions in 2055 would be 42% lower than under a scenario with no rule.

This is not yet a final rule

The proposal runs 477 pages and opens a 45-day public-comment period. Manufacturers, fleets, trade groups, shops, drivers and other interested parties can submit comments before the agency issues a final version.

Operators should not assume current DEF, SCR, sensor or maintenance obligations have disappeared. The proposal may still change.

Four proposed changes that affect trucks

1. Shorter required warranty mileage

The earlier extended warranty provision reached 450,000 miles. The new proposal would reduce certain requirements to 100,000 miles and delay implementation until model year 2030 instead of 2027. Buyers will need to read the final warranty carefully because expensive emissions repairs could shift to the owner sooner.

2. Removing automatic DEF derates

The EPA proposes eliminating derates that slow or immobilize a truck after the system detects low DEF, tampering or certain emissions faults. A visual warning or a 90-second audible alert would take its place.

That could prevent a truck from losing power in an unsafe location because of a bad sensor. It would not authorize operating without DEF or ignoring fault codes. A malfunctioning SCR system can still increase emissions, create damage and produce compliance problems.

3. Changes to regulatory useful life

The tighter useful-life provisions would be delayed until 2030. Some older trucks could therefore remain in service longer under less stringent requirements than those contemplated in the original rule.

4. Noncompliance penalties for manufacturers

The proposal would allow certain manufacturers to pay penalties while continuing to sell engines that do not yet fully meet the new standard. The stated purpose is to keep products available while compliant engines finish development.

What it means for a model-year 2027 buyer

The EPA believes manufacturers have already completed their 2027 engine designs and does not expect major redesigns for 2028 or 2029 because of these revisions. The proposal therefore may not reduce the purchase price of a new truck immediately.

A fleet's real cost will depend on final warranty coverage, failure frequency, parts and sensor availability, SCR performance and responsibility for repairs after 100,000 miles. A similar sticker price does not guarantee a similar total cost of ownership.

What road professionals should check

  • Do not modify, disconnect or ignore DEF/SCR equipment while the rulemaking is underway.
  • Keep invoices, diagnostic reports, regeneration records and emissions-system repair records.
  • Before buying a 2027 truck, obtain exact warranty coverage and mileage limits in writing.
  • Ask who pays if a sensor fails after warranty coverage ends.
  • Address emissions codes early; removing a derate does not remove the underlying fault.
  • Compare total cost of ownership, not only the purchase price or monthly payment.

Maintenance and shop impact

Removing derates could reduce sudden immobilizations, but it would place more responsibility on the operator to respond to warnings. An alert that does not stop the truck may be easy to postpone until the fault becomes a more expensive repair.

Bottom line

The EPA is not withdrawing the 2027 NOx limits. It is proposing changes to warranties, derates, useful life and penalties around those limits. For operators, warranty coverage and the truck's response to a DEF fault are the two issues most likely to affect the pocket. Until a final rule exists, maintenance and documentation remain essential.
