Nebraska Diesel Relief: Federal Rules Still Apply

Nebraska offers temporary diesel relief. Federal penalties remain separate, and agricultural refunds require qualifying trips.

Nebraska Diesel Relief: Federal Rules Still Apply

Nebraska's temporary diesel relief does not remove federal dyed-fuel penalties. That distinction matters before a harvest hauler fills a highway vehicle. The Nebraska Department of Revenue says the state relief and a request for federal relief are separate matters; a request is not an approval.

Separate two different benefits

Executive Order 26-21 suspends specified Nebraska restrictions and penalties involving dyed diesel for a temporary period. It also creates a state motor-fuel-tax refund route for qualifying transportation of Nebraska agricultural products. These are not a blanket tax exemption for every truck or every mile.

The revenue department identifies September 24 through December 23, 2026, as the relief window. The order can end or change earlier. Confirm the current guidance before relying on it for a later trip.

Match the refund to the load and miles

The guidance covers qualifying Nebraska-sourced agricultural products hauled on Nebraska roads, including interstate miles within Nebraska. It addresses livestock, grain and other seasonal products, with specified movements to storage or market and qualifying return trips. Personal-use miles do not qualify.

Form 84AG is the state's refund form. Revenue instructs claimants to identify EO 26-21 and provide supporting fuel-tax and agricultural-transport records. IFTA carriers using tax-paid undyed diesel should follow the separate reporting guidance and confirm treatment with Nebraska's Motor Carrier Division. Do not assume the same fuel purchase can be claimed twice.

Before the next dispatch

  • Identify the load's origin, delivery and eligible Nebraska miles.
  • Keep fuel receipts with trip and cargo records.
  • Separate state relief from federal rules before choosing dyed fuel.
  • Confirm the filing route and current end date.

This is an operational summary, not individual tax advice. Review the official conditions before purchasing fuel or filing a claim. Keep following Truck Savers News for route and operating updates.
