Survey Reveals: Majority of Owner-Operators Have Been Fraud Victims

50.3% of owner-operators have been freight fraud victims per Overdrive survey. Double-brokering is #1 scam (28%). Losses of $10,000+ in 28% of cases. Estimated 750,000 fake load posts/year and 2M fraudulent emails.

Survey Reveals: Majority of Owner-Operators Have Been Fraud Victims

πŸš¨πŸ’° The trucking fraud epidemic

In the midst of the worst freight market in modern history and an ongoing "fraud apocalypse," a new Overdrive survey reveals that the majority of owner-operators have suffered directly as a result of freight fraud.

The numbers are alarming.

πŸ“Š Survey Results

How Many Have Been Victims?

  • 50.3% reported being victims of some type of fraud
  • 49.7% said they haven't been victims (barely not a majority)
  • Many who "weren't victims" simply don't accept brokered freight

Most Common Fraud Types

  1. 28%: Double-brokering with reduced payment (secondary broker does pay, but less)
  2. 23%: Double-brokering with no payment (both brokers disappear)
  3. 15%: Business identity theft (they use your DOT to book loads)
  4. 14%: Blackmail or threats of reputational damage
  5. 12%: Unwitting party to cargo theft (due to broker's false credentials)

Financial Losses

  • 28% of victims lost $10,000 or more
  • Losses can mount quickly
  • One commenter said: "Lost too much money. Shut down."

πŸ” The Magnitude of the Problem

Estimated Annual Numbers

Experts consulted by Overdrive estimate:

  • 750,000 fake load posts on load boards each year
  • 2 million fraudulent emails sent in 2025 (+117% vs. 2024)
  • 8.5 million fraudulent or spoofed phone calls
  • 958 unauthorized changes to FMCSA contacts detected
  • Domestic fraud attempts from over 70 countries

Fraud Represents 15% of Cargo Theft

Scott Cornell (VP of Logistiq Insurance Solutions) estimated that "strategic theft" (theft through deception, including double-brokering) represents 28-33% of all cargo theft.

About half of that 30% is double-brokering β€” the most common method of strategic cargo theft.

Strategic theft jumped 1,475% between Q1 2022 and Q4 2024.

πŸ’Έ Offsetting: Another Broker Trap

Besides direct fraud, many big brokers (notoriously TQL) use "offsetting" clauses that allow them to withhold payment on previous loads if there's a claim on a subsequent load.

Real example: ITS Logistics tried to withhold $85,000 from Illyrian Transport after hauling dozens of claim-free loads.

Survey Results on Offsetting

  • 71% haven't experienced offsetting invocation
  • 9% managed to fight it off
  • 20% lost money to this practice

πŸ›‘οΈ How to Protect Yourself

1. Verify EVERYTHING

  • Confirm the broker directly with the shipper
  • Check the MC Number on FMCSA SAFER
  • Call the broker's official number (not the one they emailed you)
  • Use vetting platforms like Highway, Carrier Assure, etc.

2. Read Contracts

  • Look for offsetting clauses
  • Look for additional insured clauses
  • Look for subrogation waivers
  • If you don't understand something, ask a lawyer

3. Document EVERYTHING

  • Signed rate confirmation
  • Complete BOL
  • Equipment photos
  • Load photos (pickup and delivery)
  • Screenshots of communications

4. Consider NOT Working with Brokers

Many survey commenters said: "No brokered freight" β€” and that's why they've never been victims.

Building direct shipper relationships takes time, but eliminates broker fraud risk.

πŸ’¬ Owner-Operator Comments

"I hauled a third-party brokered load from Oregon to Laredo. By the time I delivered, the load had been canceled and transferred to another shipper who decided I picked up and delivered because I was doing charity work."

"Truckers have to supply all kinds of paperwork to get a load booked through a broker. What does the broker have to show to the trucker? Nothing."

"The lack of meaningful financial enforcement β€” particularly around detention pay and offsetting β€” has created a kind of Wild West that carriers are forced to navigate just to get paid at all."

πŸš› The Truck Savers Recommendation

Freight fraud is real, common, and costly. You're not paranoid if you verify everything twice.

Better to lose a suspicious load than lose $10,000 (or your entire business).

If you're starting as an owner-operator, seek advice from veterans who know the red flags. Many brokers are legitimate, but the bad ones are ruining the game for everyone.

At The Truck Saversβ„’ we know truckers who've been through this. If you need trustworthy broker recommendations or want to talk business, call us: (713) 455-5566.

πŸ’¬ Bottom Line

Half of owner-operators have been fraud victims. Losses can reach tens of thousands of dollars. The problem is getting worse.

Verify. Document. Distrust.

And if something smells bad, it probably is. 🚨
