Washington, D.C. — The Federal Motor Carrier Safety Administration (FMCSA) implemented a new regulation on March 16, 2026 that drastically restricts who can obtain or maintain a Non-Domiciled Commercial Driver's License (CDL) in the United States ⚖️📋
What Changed?
The "Restoring Integrity to the Issuance of Non-Domiciled Commercial Drivers Licenses (CDL)" rule limits eligibility for non-domiciled CDLs to:
- ✅ U.S. citizens
- ✅ U.S. nationals
- ✅ Lawful permanent residents (green card holders)
- ✅ Individuals with H-2A visas (temporary agricultural workers)
- ✅ Individuals with H-2B visas (temporary non-agricultural workers)
- ✅ Individuals with E-2 visas (treaty investors)
❌ NO longer accepted:
- Employment Authorization Documents (EADs)
- Other visa categories that were previously valid
States must verify immigration status through the SAVE system before issuing or renewing non-domiciled CDLs.
