The "Restoring Integrity to the Issuance of Non-Domiciled Commercial Drivers Licenses (CDL)" rule limits eligibility for non-domiciled CDLs to:

  • U.S. citizens
  • U.S. nationals
  • Lawful permanent residents (green card holders)
  • ✅ Individuals with H-2A visas (temporary agricultural workers)
  • ✅ Individuals with H-2B visas (temporary non-agricultural workers)
  • ✅ Individuals with E-2 visas (treaty investors)

NO longer accepted:

  • Employment Authorization Documents (EADs)
  • Other visa categories that were previously valid

States must verify immigration status through the SAVE system before issuing or renewing non-domiciled CDLs.
