DOT's Duffy: "Spot Rates Are Going Up" as FMCSA Cracks Down

Transportation Secretary Sean Duffy and FMCSA Administrator Derek Barrs announced massive operations against freight fraud, "ghost offices," CDL mills, and ELD scammers. Duffy predicts: "Your spot rates are going up" by eliminating fraudulent fleets.

DOT's Duffy: "Spot Rates Are Going Up" as FMCSA Cracks Down

The Mid-America Trucking Show (MATS) on March 28-29, 2026, was the stage for two explosive federal government announcements: Transportation Secretary Sean Duffy and FMCSA Administrator Derek Barrs promised a massive crackdown on freight fraud, "chameleon" operators, CDL mills, and fraudulent ELDs.

And Duffy was blunt: "Your spot rates are going up" when they eliminate fraudsters from the market.

๐ŸŽฏ Crackdown Targets

Tom Liberatore, director of FMCSA's Office of Compliance, revealed that the agency has open specialized operations on multiple fronts:

  • Chameleon carriers โ€” operators who constantly change DOT numbers to evade enforcement
  • Ghost offices / Principal Place of Business fraud โ€” addresses with 400-500 carriers registered
  • CDL mills โ€” fraudulent driving schools that self-certify without actual training capacity
  • ELD scammers โ€” fake devices to manipulate HOS, with 280 blocked since September
  • Identity theft โ€” nearly all fraud cases involve identity theft
  • Foreign dispatch services โ€” "almost every dispatch service traces back outside the U.S."

Liberatore said FMCSA is actively working with FBI, ATF, DOJ, and DHS because those agencies have greater law enforcement authority.

And he estimated annual losses from freight fraud and cargo theft at $750 million to $1 billion.

๐Ÿšจ "I'm Coming For Them" โ€” Barrs

Derek Barrs, FMCSA Administrator, spoke bluntly at MATS:

"Our investigators have found some addresses with 400 to 500 registered carriers. How does that happen? I'm coming for them."

Barrs promised to make rules "trooper proof" โ€” so simple that any roadside officer can apply them without confusion:

"Us troopers aren't the smartest knives in the drawer and that's all right. We have to make it simple. If the rules are so difficult to comply with and so difficult to enforce, then nothing comes into compliance."

Recent FMCSA actions include:

  • In-person audits of 1,500 CDL schools โ€” shutting down "CDL mills" that only exist on paper
  • 280 ELD registrations blocked since September, many from previously revoked providers (operating as "chameleons")
  • Chameleon carriers shut down โ€” multiple recent operations against fleets that change DOT numbers
  • Non-domiciled CDL crackdown โ€” ending the practice of getting CDLs in states where you don't live
  • English Language Proficiency (ELP) enforcement on the road โ€” California finally enforcing the law

๐Ÿ’ฌ "President Trump Wants to Make Trucking Great Again"

Sean Duffy appeared surprisingly at MATS, walking among drivers and taking impromptu questions. His statements were forceful:

"President Trump wants to make trucking great again, 100%. So many Americans who didn't pay attention have now seen all these videos of people being killed or injured on American roads, oftentimes coming from folks who were not well trained. What we're doing is to roll us back from the Wild Wild West."

Duffy announced several specific measures:

1. CDL English-Only

States will no longer be able to offer CDL exams in multiple languages. Barrs even took down bilingual signage from the FMCSA exhibit at MATS.

2. End of CDL School Self-Certification

"The last administration decided it was a good idea to let CDL driving schools self-certify that they're qualified to instruct a new driver in skills and road knowledge. Total bull$#!#. We are rolling back these schools, taking away their certifications. CDL mills are a thing of the past."

3. Operation Safe Drive

A roadside enforcement initiative to enforce ELP (English Language Proficiency) and end chameleon carriers.

4. Dalilah's Law

Duffy promoted Dalilah's law (named after Dalilah Coleman, a girl injured in a crash with a non-domiciled CDL driver). The law, advancing in Congress, would ban dispatch services operated from abroad.

Near the end of his speech, Duffy connected all the dots:

"When I have small businesses, been in families for generations and going out of business, that's because there's too much fraud and abuse in trucking. We're going to systematically roll back the fraud, prosecute the fraud, and I think what you're going to see is your spot rates are going to go up."

The logic is simple: if you eliminate fraudulent operators who operate illegally with lower costs (without complying with safety, with fraudulent CDLs, manipulating ELDs), you reduce capacity supply in the market. Lower supply = higher prices.

And with fewer "bottom feeders" stealing loads at impossibly low prices, legitimate operators can finally charge sustainable rates.

๐Ÿšš What Does This Mean For You?

If you're a legitimate owner-operator or small fleet operating legally:

  • โœ… Good news: Less competition from fraudulent operators may mean better rates
  • โœ… Stronger enforcement: If you play clean, the field is finally leveling
  • โš ๏ธ More audits: Make sure your compliance is impeccable (HOS, ELD, records, IFTA, safety)
  • โš ๏ธ ELP roadside: If you're a driver, be prepared to demonstrate English proficiency at inspections

If you operate with questionable practices:

  • โŒ FMCSA is coming for you with FBI, DOJ, DHS, and ATF
  • โŒ You can no longer just change DOT number and keep operating
  • โŒ Fake ELDs are being blocked en masse
  • โŒ Ghost offices and shared addresses are under investigation

๐Ÿ“ข How to Report Fraud

Shannon Chelf, FMCSA training specialist (20 years with Kentucky State Police), gave clear advice on reporting fraud:

  1. Get a local police report โ€” even if you didn't like how they treated you, you have documentation
  2. Upload the report to NCCDB (National Consumer Complaint Database) at fmcsa.dot.gov
  3. Don't investigate alone โ€” it can take 1,000-2,000 hours and rarely results in legal action without hundreds of victims
  4. Report even if it seems small โ€” two years later, your report may be the key piece that connects the dots

Chelf warned: "I don't think fraud is ever going to be completely stopped," but FMCSA is making its biggest effort in history to combat it.

The "Wild Wild West" era in trucking is ending. Between the FMCSA crackdown, DOT pressure, and direct support from President Trump (who mentioned Dalilah Coleman in his most important speech of the year), enforcement is reaching unprecedented levels.

For good actors who have always operated legally, this is good news. For fraudsters, the game is over.
