United States — The Federal Motor Carrier Safety Administration (FMCSA) published in March 2026 a final rule that significantly restricts the issuance of non-domiciled CDLs (Commercial Driver's Licenses for people without permanent legal residence in the U.S.) 🚛⚖️

This new regulation limits who can qualify for a non-domiciled CDL and establishes stricter verification requirements for states.

What Are Non-Domiciled CDLs?

A non-domiciled CDL is a special license that allows people who are NOT permanent residents or U.S. citizens to operate commercial vehicles in U.S. territory.

Before this rule, several states issued non-domiciled CDLs to:

  • Temporary foreign workers with various visas
  • Employment Authorization Document (EAD) holders
  • Asylum seekers with work permits

New Rule: Only H-2A, H-2B, and E-2

Starting March 2026, FMCSA limits eligibility for non-domiciled CDLs to:

EADs No Longer Accepted

The rule clearly states that Employment Authorization Documents (EADs) are NO longer sufficient to qualify for a non-domiciled CDL.

This affects:

  • ❌ Asylum seekers with EADs
  • ❌ TPS (Temporary Protected Status) holders with EADs
  • ❌ DACA recipients with EADs
  • ❌ H-1B visa spouses with EADs (H-4 EAD)

🚨 Immediate Impact

Drivers who currently have non-domiciled CDLs based on EADs:

  • Current licenses will remain valid until their expiration date
  • 🔒 Will NOT be able to renew if they don't meet new requirements (H-2A, H-2B, E-2)
  • 📋 Must seek alternatives (adjust immigration status or stop driving commercially)

States Must Verify via SAVE

FMCSA also mandated that states must use the SAVE system (Systematic Alien Verification for Entitlements) to verify immigration status before issuing or renewing non-domiciled CDLs.

What is SAVE?

In parallel, the U.S. Congress is considering legislation (backed by the Trump administration) to restrict state issuance of driver's licenses (regular, not just CDLs) to non-residents.

This would include:

  • 🔒 Eliminating "sanctuary state" driver's license programs

Removal of 9,000+ CDL Training Providers

As part of a broader effort to clean up the CDL training provider registry, FMCSA removed over 9,000 providers from the Training Provider Registry (TPR) in recent months.

Removal reasons:

  • ❌ Operated without adequate facilities
  • ❌ History of safety violations
  • ❌ Courses not meeting Entry-Level Driver Training (ELDT) requirements

What Options Do Affected Drivers Have?

If you have a non-domiciled CDL based on EAD or non-eligible status under the new rule:

  • 🟢 Green Card (Permanent Residence): Will allow you to get a regular (domiciled) CDL
  • 📋 H-2B Visa: If you work for an employer who can sponsor H-2B, you qualify for non-domiciled CDL
  • ⚖️ Consult with immigration attorney to evaluate status adjustment options

2️⃣ Train for Other Trucking Jobs

If you can't maintain your CDL, consider roles that DON'T require CDL:

  • 📋 Dispatcher / Load planner

  • 🛞 Yard jockey (some don't require CDL if operating only on private property)
  • 🚚 Light vehicle driver (box trucks under 26,001 lbs GVWR)

3️⃣ Return to Your Country with Experience

If you already have U.S. driving experience:

  • 🌎 Many countries need qualified drivers (Mexico, Canada, Central America)
  • 📄 Your safety history and experience can be valuable in international markets
