If you cross the border with international cargo or work with importers, this week brought confusing news: the U.S. Supreme Court invalidated certain emergency tariffs, but at the same time new blanket surcharges were enacted on imports.

The result: more uncertainty for everyone moving cargo between the U.S., Mexico, Canada, and the rest of the world.

What Happened?

📜 Supreme Court Invalidates Emergency Tariffs

The previous administration had imposed emergency tariffs under Section 232 (national security) and Section 301 (unfair trade practices) on products from certain countries.

The Supreme Court ruled that some of these tariffs were too broad and didn't follow correct legal procedures. Result: several tariffs were invalidated or suspended.

💸 But... New Surcharges Enter

However, almost simultaneously, new blanket import surcharges were enacted under different legal authorities. These surcharges are more specific but still add significant costs to imported products.

In other words: they removed some tariffs through the front door but brought in new ones through the back door.
