It's called the non-domiciled CDL rule, and it basically states that your CDL must be issued by the state where you legally reside (your state of domicile).

Who's Affected?

If your commercial driver's license (CDL) was issued by a different state than where you currently live, you could be in trouble.

Common examples:

  • You live in Texas, but your CDL is from Florida (many driving schools do this)
  • You moved from one state to another and didn't update your CDL
  • You got your CDL in another state for convenience or cost, but never lived there

The FMCSA estimates there are up to 200,000 CDLs in this situation.

Why Now?

This rule comes after several serious accidents involving foreign-born drivers or drivers with irregular licenses.

The Trump administration is pushing for tougher rules for commercial licenses, especially after high-profile crashes involving foreign-born drivers.

What Will Happen?

Analysts from FreightWaves and other sources say that if this rule is strictly enforced, we could see:

  • Immediate capacity shortage — fewer available trucks
  • Double-digit spot rate increases (10%+ or more)
  • Higher load rejections (already at 2022 levels)

The freight market is already tight:

  • Spot rates jumped 24% (dry van) and 27% (reefer) year-over-year
  • Truck posts are at a 10-year low (week 9 of 2026)
  • Tender rejection rates are at levels not seen since 2022

If we remove 200,000 drivers from the system, freight prices will shoot up. Fast.

Other Active Regulations in 2026

The CDL rule isn't the only new regulation:

1. Broker Financial Responsibility (January 16)

Brokers and freight forwarders now need stricter financial instruments to operate. Many small brokers are leaving the market.

2. English Proficiency at Roadside Inspections

Inspectors can now verify English fluency during roadside inspections. If you can't communicate effectively, they can put you out of service.

3. ELD Decertifications (Deadline April 14)

Several ELD devices are being decertified. If your ELD is on the list, you have until April 14 to replace it.

4. Electronic Medical Certification

The electronic medical certification system for CDL drivers is fully implemented. Your medical certificate must be verified in your state's Motor Vehicle Record (MVR).

The American Trucking Associations (ATA) projects a deficit of over 80,000 drivers in the U.S. in 2026.

Some reports cite a current shortage of 20,000 drivers, but trends suggest that number will grow.

3. Check Your ELD

Verify that your ELD isn't on the decertified list. If it is, replace it before April 14.
