Used trucks hide their compliance problems in the build date.

49 CFR 393.55 does not ask what your truck has today.

It asks when the truck was built, and then names what it must carry.

Check the certification label before you check the paint.

Three dates decide whether antilock brakes are required at all.

Three dates, and each one covers different iron

March 1, 1997 — truck tractors. Every truck tractor built on or after that date must have an antilock brake system meeting FMVSS No. 121.

March 1, 1998 — the rest of the air-braked fleet. Every other air-braked commercial motor vehicle from that date on: trucks, buses, and on the towed side semitrailers, converter dollies and full trailers.

March 1, 1999 — hydraulic brakes. Every truck and bus built on or after that date with a hydraulic brake system, under FMVSS No. 105 instead.

One carve-out runs through all three: vehicles in driveaway-towaway operations are excepted. If you are not moving equipment that way, the exception is not yours.

The lamp is part of the requirement, not an accessory

People read the rule as "must have ABS" and stop. The section keeps going, and the rest is about telling you when it has stopped working.

A hydraulic-braked vehicle covered by the rule must also carry an ABS malfunction indicator. Air-braked vehicles must carry an electrical circuit capable of signalling a malfunction in the system.

So a truck with a working ABS and a bulb nobody replaced is not quietly fine. The indicator is written into the same section as the brakes.

Two more dates, for equipment that pulls

Here is the part almost nobody quotes, and it is the one that bites when you mix old and new iron.

March 1, 2001 — the tractor side. Every truck tractor from that date, and every single-unit vehicle equipped to tow another air-braked vehicle, must be able to carry the trailer's malfunction signal forward into the cab, to the trailer ABS lamp on the dash, and must provide the means of connection.

March 1, 2001 — the trailer side. Every semitrailer, converter dolly and full trailer from that date must be able to signal its own ABS malfunction and connect that circuit to the towing vehicle. And if the trailer is built to pull another air-braked trailer, it has to relay that one's signal forward too.

Read those two together and the design intent is obvious: the fault has to travel up the combination until it reaches a human. A trailer that knows it has a problem and cannot say so up the line does not satisfy the rule.

And the lamp on the outside

One more, and it is the easiest to check on a walkaround: every trailer, converter dolly included, built on or after March 1, 1998 and covered by the air-brake paragraph must have an exterior ABS malfunction indicator lamp.

Outside. On the trailer. Where you can see it standing next to the unit, without a cab, without power to the dash, without anybody helping you.

That is the one to look for on a used trailer, because it tells you two things at once: whether the trailer is in scope, and whether anyone has been maintaining the circuit.

What this means at the auction

The practical version of the whole section is short.

Find the build date first. Not the model year on the ad — the date on the certification label. That single number decides which of the five dates above applies to the unit in front of you.

Then look for the lamp before you look at the paint. On a trailer, outside. On a tractor from 2001 on, the trailer ABS lamp in the cab, and whether the connection for it exists at all.

And treat a burned-out indicator as a finding, not a detail. The rule puts the light and the brakes in the same sentence, so an inspector can too.

None of this requires a scan tool. It requires knowing that the year stamped on the label is the first question, and that the answer changes what the law expects of that specific unit.
